•The three winners (Grand Prize, 2nd Place, and 3rd Place) will be announced on 9News and Carpet Mill Outlet Stores Facebook pages The “Ugly Carpet” receiving the most likes/comments will be the winner of the grand prize. Voting will occur through November 22, 2020. The most liked/commented on entry by 11:59 PM on November 22, 2020, determines the final winner. The winner will be announced on the Sponsor’s website on November 23, 2020.

• The three winners will be contacted via email that was provided on entry form. (See Terms and Conditions Below, #7)

• Must present winner certificate to salesperson at time of sale. Materials only. No cash value. One Grand Prize winner, one $500 gift certificate winner, and one $250 gift certificate winner. Winner names will be published on social media. Must be 18 years of age to participate. Colorado residents only. Gift certificates will be honored at all locations.

Contest Terms and Conditions

1. Eligibility

   Ugly Carpet Contest (the “Contest”) is open to legal residents who are at least eighteen (18) years old at the time of entry with residential homes within a 25-mile radius of Carpet Mill Outlet Stores showroom locations Arvada 7370 W. 88th Ave, Arvada, CO 80003  |  Aurora,1300 S. Abilene, Aurora, CO 80012  |  Aurora South /Parker, 13714 E. Quincy Ave., Aurora, CO 80015  |  Fort Collins, 4950 S College Ave., Fort Collins, CO 80525  |  Denver, 1485 S. Colorado Blvd., Denver, CO 80222  |  Highlands Ranch, 2670 E. County Line Rd. # D, Littleton, CO 80126  |  Lakewood, 9840 W Colfax Ave., Lakewood, CO 80215  |  Littleton, 1613 W. Belleview, Littleton, CO 80120  |  Southwest, 9086 W. Bowles, Littleton, CO 80123  |  Thornton, 3817 E. 120th Ave., Thornton, CO 80233. Homes beyond this radius will be excluded. Employees of Carpet Mill Outlet Stores and other companies associated with the promotion of the Contest, and their respective parents, subsidiaries, affiliates, and advertising and promotion agencies, as well as the immediate family, will be excluded. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, cohabitation or other family extension, and any other persons residing at the same household whether or not related. The Contest is subject to federal, state, and local laws and regulations.

   Agreement to Official Rules

3. Participation in the Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.

4. Contest Period

   The Contest begins on September 28, 2020, at 12:00am Central Daylight Time and ends on November 22, 2020, at 11:59 pm Central Daylight Time (the “Contest Period”). Entries that are submitted before or after the Contest Period will be disqualified. Submissions will be accepted for the duration of the Contest using any of the following methods: Facebook Event Online

5. How to Enter

   Online: This method of entry will be available by visiting our website (https://carpetmilloutletstores.com/ugly-carpet-contest) and following the directions provided to fill out the entry information, and submit.

   Limit one (1) entry per person, per email address, and per household for the duration of the Contest Period, regardless of method of entry. Entries received from any person, e-mail address, or household in excess of the stated limitation will be void. All entries become property of the Sponsor and will not be acknowledged or returned.

6. Photo Entries

   By submitting your photo, the participant grants the Sponsor permission to use the submitted photo in marketing materials, including but not limited to online advertisements, email newsletters, social media posts and more. By submitting your photo, you agree to waive any proprietary claims against the photo.

   Submitted photos must not infringe or violate any trademark, copyright, publicity right, privacy right or any other right of any person or entity, under any applicable law, and must be the original creation of the participant.

   The Sponsor reserves the right to disqualify any photo we deem inappropriate.

7. Prize Drawing

   Entries may be submitted between September 28, 2020, and November 15, 2020. Contest entry ends on November 15, 2020; no entries will be accepted after this date. The “Ugly Carpet” receiving the most likes/comments will be the winner of the grand prize. Voting will occur November 16, 2020 through November 22, 2020. The most voted entry by 11:59 PM on November 22, 2020 determines the final winner. The winner will be announced on the Sponsor’s website November 23, 2020. The Sponsor will attempt to notify the potential winner via email on or about November 23, 2020. If the potential winner does not respond within five (5) days after the date of the first attempt to contact him/her, the Sponsor may select an alternate potential winner in his/her place at random from the remaining non-winning, eligible entries.

8. Winner Notification

   The potential winners will be notified by email. Each potential Grand winner (parent/legal guardian if a minor in his/her state of residence) will be required to complete, electronically sign and submit a Declaration of Compliance within (5) days of the date notice or attempted notice is sent, in order to claim his/her prize. If a potential winner cannot be contacted or fails to submit the Declaration of Compliance within the required time period (if applicable), or prize is returned as undeliverable, potential winner forfeits prize. If the potential winner is at least 18 but still considered a minor in his/her jurisdiction of residence, Sponsor reserves the right to award the prize in the name of his/her parent or legal guardian, who will be required to sign the Declaration of Compliance on the potential winners’ behalf and fulfill any other requirements imposed on winner set forth herein. Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded. Prizes will be fulfilled approximately 30-60 days after the conclusion of the Contest.

9. Prizes

   Grand Prize is 1000 sqft Stainmaster® Carpet, 1/2” pad and installation valued at $3,000. Winner will select from Stainmaster® Carpet Style at any one of our 12 locations. Any amount over the $3,000 will be the responsibility of the contest winner. No credits issued if new flooring installation is less than $3,000. All credits and the grand prize MUST be used by 12/31/2020.

   2nd Place will receive a $500 gift certificate. Minimum total purchase of $1,000 required to redeem $500 gift certificate. Materials only.

   3rd Place will receive a $250 gift certificate. Minimum total purchase of $500 required to redeem $250 gift certificate. Materials only.

   All any and all prizes cannot be combined with any other offers. Only to be used on new purchases – cannot be applied to existing jobs, invoices or balances.

10. Social Media

    By entering you acknowledge a complete release of Facebook or any social media platform. This Contest is not sponsored, endorsed, or administered by, or associated with, Facebook or any social media platform. The information you are providing is to Carpet Mill Outlet Stores, not Facebook or any social media platform. 

11. A minimum number of ten (10) contest entrants are required before the contest can proceed. If the contest does not receive the minimum number of entrants before the advertised contest end time, the Sponsor reserves the right to extend or cancel the contest.

12. Release and Limitations of Liability

    By participating in the Contest, entrants agree to release and hold harmless the Sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Contest and each of their respective officers, directors, employees, shareholders, representatives, and agents (the Released Parties) from an against any claim or cause of action arising out of participation in the Contest or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Contest; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) application downloads, (e) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, the incorrect downloading of the application, the processing of entries application downloads or in any Contest-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Contest or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Contest, and in no event shall the entrant be entitled to receive attorney’s fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

13. Disputes

    Except where prohibited, each entrants agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Illinois. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrants rights, and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by and constructed in accordance with, the laws of Illinois, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Illinois.
